GENERAL TERMS OF SALE

1. Scope

These general sales conditions disclose and define all information users will need about types of orders, sales, payments and delivery of purchases made through the website www.alojadogatopreto.com, property of:
Portugal: Gato Preto, with its head office at Alameda Fernão Lopes nº16, Edifício Premium, 3º A, 1495 -190 Algés, Tax Number 501 774 335 and a Share Capital of 340,000€.
Spain: Gato Preto – España, S.R.L., with its head office at C/ Impresores, 20. P. E. Prado del Espino, Boadilla del Monte, 28660-Madrid., Teléfono 916-175-619 CIF: B83417337 y Capital Social: 5.000€, inscrita en el registro Mercantil de Madrid al tomo 18007, libro 0, folio 132, hoja número M-311233.
France: Gato Preto France SARL, with its head office at 20 Quater, Rue Schnapper les Tanneries Royales, 78100 Saint-Germain en Laye, SIREN no. 530 009 307 R.C.S. Versailles and a Share Capital of 5.000€ (hereafter designated jointly as Gato Preto).

These are the only applicable general sales conditions and replace all other conditions, except by prior express written agreement.It shall be regarded that, on validating a purchase order, the user accepts these general sales conditions.

2. Product
Images of products available on the website are as realistic as possible and aim to provide an identical and realistic representation of the product. Considering that some products are hand-made, there may be slight differences between the image and the product itself caused by the nature of raw materials and the production process.

3. Order

3.1 Placing an Order
The products shown on the website are available for sale in Portugal (Mainland and Islands), Spain (Peninsular and Balearic Islands) and Continental France (this excludes Islands, colonies or other territories not listed under administration of these countries).

To place an order on the website, users are required only to have an e-mail account and to follow the steps below:

  • Select the online shop of the country where the order will be delivered;

  • Select the products to be purchased and add them to the shopping cart;

  • Register in Gato Preto Online, create a personal account where it is possible to access and update your personal data and check the status of your orders or returns;

  • Fill out all mandatory fields and select the desired payment option;o Accept the General Sales Terms and Conditions and click on "Buy Now";

  • When the purchase has been completed, a screen will display the purchase confirmation and details, which may be printed as proof of purchase.


You will also receive an automated e-mail with this information. When using the Portugal Online Shop, users will receive an SMS notice when their order is shipped.
On submitting the order, users accept the website’s General Sales Terms and Conditions as well as the Personal Data Protection and Privacy Policies specified in the website’s footer.

3.2 Non-processing of the Order
Gato Preto reserves the right not to process orders when there is no guarantee of proper payment, when orders are incomplete or incorrect or if the respective product is no longer available.

In these cases, users will be notified by e-mail about the cancellation and will be refunded any amount already paid. Gato Preto also reserves the right to cancel any order, even when performed successfully, and shall not be liable for losses or costs when any of the following situations are applicable:

  • Unavailable product (in this case, the amount paid by the user will be refunded through the same payment method used for the order);

  • Incorrect billing information;

  • Payment for the order was not received (up to 8 business days after the order);

  • Product price error;

  • The order could not be delivered to the specified delivery address.


4. Product Availability
Fulfilling orders placed through the website is subject to the availability of products in stock. If a specific product is temporarily out of stock or if the client placed an order for a product that in the meantime sold out, Gato Preto will send an e-mail to the user indicating the approximate date on which the product will be available. The user may choose whether to maintain the order or to cancel it.

Whenever possible, Gato Preto will attempt to deliver all ordered items in one single shipment. However, if any of the ordered items is delayed or temporarily unavailable, the order may be delivered in stages. In this case, the user will be informed by e-mail.

5. Price
Product prices are those specified in the website, except for evident errors. Although the website is updated daily, some product prices may be incorrect. In this situation,Gato Preto will notify the user as soon as possible, enabling the user to confirm the order with the correct price or to cancel it, in which case the user will be entitled to a full refund of the paid amount. When the user cannot be contacted, Gato Preto reserves the right to cancel the placed order and to refund the full amount paid. Prices shown on the website already include Value Added Tax (VAT) as applicable in the country where the order was placed.If the users wish so, they may request the order to be delivered to their home address, whereby an additional delivery fee will be added to the product price. If the order exceeds the minimum value specified for the country in which the order is placed, the delivery will be free of charge.The total payment includes the product price, VAT and the delivery fee.Product prices may be altered and updated.
Gato Preto reserves the right to alter prices without prior notice. However, the price shown when the purchase is made is the price actually charged, except in case of an evident error.

6. Payment Methods
The website offers the following payment methods to be selected according to what is most convenient for users:

  • VISA/MASTERCARD credit card;

  • PayPal;

  • ATM reference number (Portugal only).


If you wish to pay by credit card or PayPal, all credit card/PayPal information is filled out directly on a secure page of the electronic payment service supplier.

Gato Preto shall not be liable for any delay or delivery failure caused by verifications and authorizations by the respective issuing entities. The invoice will be available in the user's personal account, in PDF format, when the order is shipped or delivered in-store. When performing the order, the user agrees with this condition.

7. Shipment and Delivery

7.1. Shipment
The order shipment process will start after confirmation that the respective order has been fully paid.

7.2. Delivery

The user may select one of two delivery options: the order may be delivered to a chosen address or picked up at one of Gato Preto stores (except in France). The home delivery service is performed by a courier and functions during business days, from 9h00 to 18h00, for deliveries in Portugal (Mainland and Islands), Spain (Peninsular and Balearic Islands) and Continental France. DELIVERY TIMES

Delivery times are only valid after confirmation of successful payment of orders. The deadlines shown are indicative only. The final delivery date is confirmed by the carrier.

Express (exclusive small volumes): up to 4-5 working days (mainland Portugal), up to 5-6 working days (São Miguel and Madeira) and up to 6-7 working days (Porto Santo, Terceira, Santa Maria, Corvo, Pico, S. Jorge, Graciosa, Flores).

Light and Plus: Items with exclusive home delivery (sofas, furniture and other large volumes) may have different delivery times from the others, depending on their availability. Sofas can take up to 30-60 working days. During the campaign period and on some of the sofas marked, this time may be longer than expected.

Note: The estimated delivery time is valid after confirmation of the order's good payment. The home delivery service cannot be scheduled, and the process varies depending on the country:

  • Portugal: The courier will inform the user, via text message or e-mail, about the estimated delivery date, the user has the possibility of changing the said date or of choosing to collect his or her order from a nearby pickup point. The courier shall deliver the order to the address the user had previously selected. For products that are only home-delivered (products with special characteristics or high weight/volume) the user will have to wait for the contact to schedule the delivery date of the order.

Note: The estimated delivery time is valid after confirmation of the order's good payment. The home delivery service cannot be scheduled, and the process varies:

  • France: The courier will inform the user, via text message or e-mail, about the estimated delivery date, and will carry out one delivery attempt to the address the user had previously selected. If this attempt fails, the order shall be sent to the nearest pickup point, where it can be retrieved during the following 5 business days.


7.3. Pick up at Store:
If you prefer, you can collect your order from one of our stores, by simply indicating it on the shipping method and choosing the store where you want to pick it up (except France). In this case, the shipment will not have any costs. When your order is available at the store you will receive an e-mail with this information within:

  • Portugal: 5 to 7 business days;

  • Portugal São Miguel/Madeira: 8 to 12 business days;

  • Spain (Peninsular): 5 to 7 business days.


To collect your order, you must present a copy of the invoice, printed from the website, sign it and deliver it at the time of the pick-up. The invoice can also be presented on a mobile device. Your order will be available for pick up at the store for 15 days, after receipt of the e-mail indicating the products’ availability at the store.

8. Cancellations and Returns

8.1. Order Cancellation
It is not possible to change or cancel an order once it has been processed.

8.2. Return by Change of Mind
The user has a 14-day period of reflection during which the product may be returned if the user is not satisfied, provided that:

  • The product has not been used or tampered with;

  • The product maintains its original characteristics and the package is not totally damaged;

  • The product is complete and properly packed in the original package (if the item consists of more than one part, all parts must be returned);

  • The proof of purchase or invoice and the return document must be attached.


To begin the return process, the user must contact our Customer Service, sending an e-mail to online@gatopreto.com , identifying the products that are going to be returned. In this e-mail, the following data must be included:

  • Order number;

  • Product references;

  • Quantity of items to return per reference number;

  • Reason for the return;

  • Return location (central warehouse or store).

To give up on the order, the user must fill this form.

The user can then return the products to one of the following locations:

Along with the products, the user must also send the return document and the order invoice. Please note that shipping costs, arising from the return of products to our warehouse, are to be paid by the user.

2. Store

Communication: We extended the exchange period to January 31, 2021. Make your Christmas purchases in advance and ensure your safety. The products must be in the original condition and will be exchanged for others of equal or greater value with a presentation of proof of purchase*

The product may also be returned to any of the Gato Preto stores (except Freeport Outlet Alcochete/Portugal and in France), by attaching the return document and the invoice, which shall be signed and delivered at the store as proof of the return.

After the products have been received and verified, Gato Preto will refund the purchase value to the client within 14 days. The order's shipping costs will be reimbursed to the customer only if there is a manufacturing defect in the ordered items.

Gifts: A gift item must be returned by the person who purchased the item in the online shop and not by the person who received the gift. The steps for returning an item by change of mind must also be followed.

Products that are home delivery only
For these products, the return in-store is not available. They can be returned to our central warehouse or request the product collection service for return (this service has an associated cost).

8.3. Returning Defective Products
If during 30 days after picking up/receiving the order, the users detect any manufacturing product defects, they may return the product by following the steps mentioned above.

8.4. Refund Method
The applicable refund will be made by the same method as the one used to pay for the purchase (credit card, PayPal or ATM reference). When the purchase is paid through an ATM reference, the refund will be made by bank transfer, whereby the user must indicate the IBAN for that purpose. In credit card payments, the user must check its credit card statement; in PayPal payments, the user must check its PayPal account balance.
The refund will be made within 14 days after product reception at the store or warehouse. Any questions regarding returns must be addressed to online@gatopreto.com .

9. Product Warranty
A product’s warranty is valid for 2 years as of the date of purchase on the website by submittal of the purchase invoice. The warranty does not cover products that were used improperly or incorrectly handled/applied by the user. To submit a warranty claim, the user must visit one of the stores or contact us at online@gatopreto.com

10. Campaigns and Promotion Codes
Whenever the website is featuring a campaign, the specific conditions, such as user eligibility, duration, exclusions, etc., will be detailed on the campaign’s respective page. Campaigns available on the website and promotion codes are valid only for purchases on this website.

11. Alterations
Gato Preto may at any time and without prior notice alter these conditions or, when such is the case, stipulate new conditions by publishing them on the website and thereby disclose them to users when they access the website and before any transactions. When a user validates an order request, such will imply that the user accepts the said modified conditions after the applicable alterations have been performed.

12. Disclaimer of Warranties and Liability
Gato Preto points out that, although the website is updated under strict precautions, information about products and their price may still contain errors, which means we do not commit to the offer and reserve the right to cancel the user’s request if such an error takes place. Gato Preto will be liable for any losses incurred by the User resulting from the online sales service only when the said losses result from intentional misconduct by the former, whereby users recognize and accept full responsibility and risk entailed in using the website and its offered services. In jurisdictions that do not allow the exclusion and limitation of specific guarantees, the liability of Gato Preto shall be limited to the extent permitted by law.

13. Processing of Personal Data
The user authorizes the processing of personal data supplied through the purchase order, in particular, through the use of cookies under the stipulations in the “Legal Notices”.

14. Customer Support
We kindly ask you to send us your questions and suggestions, as well as any complaint or claim through our contact form, or through the postal address (Alameda Fernão Lopes nº16, Edifício Premium, 3º A, 1495 -190 Algés, Portugal) or from indicated email (online@gatopreto.com).
Your complaints and claims to our customer service will be dealt with in the shortest possible time and, in any case, within a maximum period of one month.
If you, as a consumer, consider that your rights have been violated, you can direct your complaints to us via the email address online@gatopreto.com to request an out-of-court dispute resolution.

15. Alternative Conflict Resolution
If the acquisition was concluded on our website, under Regulation (EU) 524/2013 of the European Parliament and of the Council of May 21, 2013, you can request an alternative dispute resolution procedure online on consumer matters at the following address: http://ec.europa.eu/consumers/odr/
